These terms cover booking a shoot with Luke Tarr Photography ("I" or "me") and using this website. By booking or using the site, you agree to them. If we agree on something different in writing, even in an email, that agreement wins.
Booking and pricing
The prices on this site are a starting point. When you send an inquiry, I'll reply with a quote for your shoot, including any add-ons or travel fees. Your shoot is booked once I confirm a date with you. The price in that confirmation is the price you pay, even if the prices on the site change later.
Payment
Payment is due when your gallery is delivered unless we agree otherwise. I'll tell you how to pay when I confirm your booking. I may hold back downloads until an overdue invoice is paid.
Rescheduling and cancellations
- You can reschedule or cancel for free with at least 24 hours' notice.
- If you cancel with less notice, or I arrive and can't get in, there's a $50 trip fee.
- If weather ruins the exteriors or the aerial shots, I'll reshoot them on a better day at no charge. Interiors can usually go ahead in any weather.
- If I have to cancel because I'm sick, my equipment fails, or there's an emergency, I'll reschedule as soon as I can. If that doesn't work for you, I'll give you a full refund.
Your part
For real estate shoots, please make sure the property is ready and I can get in at the scheduled time. My prep checklist covers what to do. By booking, you confirm you have the owner's permission for the property to be photographed. Drone flights depend on weather and airspace rules, and I'll only fly when it's legal and safe.
For portraits, please arrive on time. Anyone under 18 needs a parent or guardian to book and attend.
Delivery
Turnaround times on this site are typical, not guaranteed. I'll let you know if anything will be late. Photos are delivered through a private online gallery, which stays up for one year after delivery unless we agree on a different date. Please download everything you need during that year. After that, I may still have copies I can send if you ask, but I can't promise it.
Editing style, the choice of which frames to deliver, and the final look are part of my creative judgment. If something isn't right, tell me within 7 days of delivery and I'll fix the edits or reshoot what's needed.
Copyright and how you can use the photos
I own the copyright to every photo I take. When your invoice is paid, you get a license to use the photos as described below. The license is non-exclusive, meaning I can still use the photos too.
Real estate. You, the listing agent or the owner who hired me, can use the photos to market and sell or rent that property. That includes the MLS, listing sites, print, social media, and your own portfolio and advertising. You may not sell the photos or pass them on to other people for their own use, such as another agent, a builder, a stager, or a designer. Anyone else who wants to use them should contact me for their own license. If the listing moves to a new agent, they'll need to contact me too.
Portraits. You can print, share, and post your photos for personal use, and a credit is always appreciated. Business headshots can be used for your professional profiles and company website. Commercial use, such as advertising, products for sale, or stock, needs my written permission.
Business and brand shoots include the usage described in the package, normally web, social, and print for your business.
Please don't add filters or make heavy edits that change how the photos look. Cropping and resizing are fine. If you use virtually staged photos, you're responsible for labeling them as staged where your MLS or local rules require it.
How I may use the photos
I may show real estate photos in my portfolio, on social media, and in my own marketing. I'll ask before sharing portrait sessions publicly. If you'd rather I not share any photos from your shoot, just tell me.
Limits on liability
I take great care with every shoot. Still, if something goes wrong on my end, the most I'll owe you is a reshoot or a refund of what you paid for that shoot. I'm not responsible for delays or losses outside my control, such as weather, property access, or service outages.
Using this website
The photos and text on this site are mine. Please don't copy, download, or reuse them without asking. Don't misuse the site, for example by sending spam through the contact form or trying to access galleries that aren't yours. If you have a gallery link, please share it only with people you want to see the photos.
How I handle your information is covered in the privacy policy.
The legal bits
These terms are governed by Pennsylvania law, and any dispute will be handled in Allegheny County. If one part of these terms turns out to be unenforceable, the rest still applies. I may update these terms from time to time. The version in place when you booked applies to your shoot.
